THE KING'S MOST EXCELLENT MAJESTY IN COUNCIL

WHEREAS circumstances have arisen in the Colony of Hong Kong (hereinafter called "the Colony ") which make it expedient that pro- vision should be made whereby so long as the said circumstances con- tinue, certain functions exercisable by the Governor of the Colony (hereinafter called "the Governor ") and other authorities under laws in force in the Colony should be exercisable otherwise and that such laws should be modified in other respects:

NOW, THEREFORE, His Majesty in exercise of all powers enabling Him in that behalf, is pleased, by and with the advice of His Privy Council, to order, and it is hereby ordered, as follows:

1.-(1) This Order may be cited as the Hong Kong (Temporary Pro- Short title visions) Order in Council, 1942.

and inter-

(2) The Interpretation Act, 1889, shall apply for the interpretation of pretation. this Order as it applies for the interpretation of an Act of Parliament.

2. (1) Notwithstanding anything contained in any enactment, the Application Crown Agents for the Colonies shall have power, with the approval of of moneys the Secretary of State, to apply any funds or moneys for the time being of Hong under their control and belonging to the Government of the Colony, for Kong any of the following purposes: -

(a) the discharge of any debts or obligations of the Government of

the Colony;

(b) the payment of salaries of persons in the service of the Govern- ment of the Colony or pensions, gratuities and allowances at rates prescribed by law, of persons formerly in that service; (c) the payment of pensions, gratuities or allowances, and the making of grants, at rates prescribed by law or, where no rates are so prescribed, at such rates as the Secretary of State shall determine, to or for the benefit of persons mentioned in the foregoing paragraph, or their wives, children and dependants whether such persons are living or not, or, in special cases, to or for the benefit of other persons resident or previously resident in the Colony, or their wives, children and dependants whether such persons are living or not; (d) the making of grants to any fund or association the purposes of which for the time being include the assistance of any persons mentioned in the preceding paragraph;

(e) any other purposes of the Government of the Colony: Provided that nothing in this sub-section shall authorise the applica- tion, except for purposes prescribed in the Currency Ordinance, 1935, as amended by subsequent Ordinances or for the redemption of Hong Kong currency, of any monies of the Exchange Fund established by that Ordinance other than interest received on behalf of the Fund on or after the twenty-sixth day of December, 1941.
